Approbationen und Berufserlaubnisse Gehört zum Bereich Umwelt, Gesundheit, Arbeitsschutz

Wer als Arzt/Ärztin, Zahnarzt/Zahnärztin, psychologische/r Psychotherapeutin/-therapeut, Kinder- und Jugendlichenpsychotherapeutin/-therapeut oder Apotheker/in in Deutschland arbeiten will, muss dazu schriftlich eine staatliche Erlaubnis beantragen. Sie wird als Approbation oder als Berufserlaubnis erteilt. Wer eine Approbation oder eine Berufserlaubnis hat und im Ausland arbeiten möchte, braucht dafür zusätzlich eine Unbedenklichkeitsbescheinigung.

Für die Erteilung von Approbationen, Berufserlaubnissen und Unbedenklichkeitsbescheinigungen ist die Bezirksregierung Arnsberg zuständig, wenn eine Antragstellerin oder ein Antragsteller

die Abschlussprüfung im Regierungsbezirk Arnsberg abgelegt hat,
die Abschlussprüfung im Ausland abgelegt hat und die Berufstätigkeit im Regierungsbezirk Arnsberg aufnehmen beziehungsweise weiter ausüben will oder
im Regierungsbezirk Arnsberg wohnt und noch keine Stellenzusage hat.
Approbation

Die Approbation

berechtigt zur selbständigen Berufsausübung.
wird unbefristet erteilt.
ist für die gesamte Bundesrepublik Deutschland gültig.
Auf Grund der Änderung der Rechtslage zum 01.04.2012 kommt es bei der Erteilung der Approbation auf die Staatsangehörigkeit nicht mehr an.

Berufserlaubnis

Besteht kein Rechtsanspruch auf Approbation, kann unter bestimmten Voraussetzungen eine Berufserlaubnis erteilt werden. Diese jedoch

berechtigt nur zur Berufsausübung unter der Aufsicht einer/eines approbierten Berufsangehörigen.
wird befristet und in der Regel nur auf Widerruf erteilt.
ist auf ein bestimmtes Bundesland und auf bestimmte Beschäftigungsstellen beschränkt.
kann auch in jeder anderen Hinsicht einschränkt werden.
Ein Rechtsanspruch auf die Erteilung einer Berufserlaubnis besteht nicht.

Auf Grund der Änderung der Rechtslage zum 01.04.2012 können Berufserlaubnisse zur Durchführung einer Weiterbildung nicht mehr erteilt werden. Nach dem Wegfall der Staatsangehörigkeitsvorbehalte kommt für diesen Zweck nur eine Approbation in Betracht.

Unbedenklichkeitsbescheinigung (Certificate of good standing)

Die Gültigkeit einer Unbedenklichkeitsbescheinigung ergibt sich aus den Vorschriften des Landes, in dem der/die Antragstellende tätig werden will.
