Lehnt die Gegenpartei den Anspruch ab oder erklärt sie sich nicht innerhalb von vier (4) Wochen nach der Geltendmachung des Anspruchs, so verfällt dieser, wenn er nicht innerhalb von drei (3) Monaten nach der Ablehnung oder dem Fristablauf von 4 Wochen gerichtlich geltend gemacht wird.
