Um die Approbation in Deutschland zu erhalten, müssen ausländische Ärzte eine entsprechende fachliche Qualifikation vorweisen. Die „Eignungs- und Kenntnisprüfungen“ sind nun einheitlich geregelt.

Noch nie gab es in Deutschland so viele ausländische Ärztinnen und Ärzte: 32 548 waren 2012 in der Bundesrepublik gemeldet. Vor allem Ärzte aus Rumänien, Griechenland, Ungarn, Bulgarien und Syrien kommen derzeit nach Deutschland. Diese Entwicklung hat eine Debatte über die Sprachkenntnisse und die medizinisch-fachliche Qualifikation ausländischer Ärzte ausgelöst. Die Überprüfung ist Sache der Bundesländer.

Zumindest in Bezug auf die medizinische Qualifikation gibt es nun bundesweit einheitliche Vorgaben. Das Bundesgesundheitsministerium hat in einer Rechtsverordnung geregelt, wie die „Eignungs- und Kenntnisprüfungen“ (Kasten) für ausländische Ärzte auszusehen haben. Es handelt sich um eine Konkretisierung der Bundesärzteordnung. Die Vorgaben werden in der Approbationsordnung verankert und gelten ab Januar 2014.

So wurde festgelegt, dass eine „Kenntnisprüfung“ als mündlich-praktische Prüfung mit Patientenvorstellung stattfindet und mindestens 60 Minuten dauert. Die Prüfung beinhaltet Innere Medizin und Chirurgie. Aber auch Aspekte aus anderen Fächern sollen vorkommen. Außerdem können die Behörden weitere Fächer als prüfungsrelevant einstufen, in denen wesentliche Unterschiede im Vergleich zum deutschen Abschluss bestehen. Die „Eignungsprüfung“ ist ebenfalls künftig eine mündlich-praktische Prüfung mit Patientenvorstellung. Sie dauert mindestens 30 Minuten.

Die Verordnung lässt jedoch nach wie vor viel Spielraum. „Wir hätten uns zur Kenntnis- und Eignungsprüfung etwas detailliertere Vorgaben gewünscht, um einen bundeseinheitlichen Vollzug zu gewährleisten“, erklärt Hans-Jörg Freese, Sprecher des Marburger Bundes.

Derzeit gehen die Länder unterschiedlich vor. Häufig berufen die für die Approbation zuständigen Behörden – also etwa Bezirksregierungen oder Landesämter für Gesundheit – selbst Prüfungskommissionen. In Rheinland-Pfalz beispielsweise führt die Landesärztekammer die Prüfungen im Auftrag des zuständigen Landesamtes durch. „Die Abschlüsse aus Drittstaaten sind oft nicht gleichwertig“, berichtet Dr. med. Jürgen Hoffart, Hauptgeschäftsführer der Landesärztekammer Rheinland-Pfalz. Das bestätige sich in den Kenntnisprüfungen: Etwa 50 Prozent der Teilnehmer fallen durch.

Wie streng sollen die Prüfungen sein? Wer soll prüfen? Tatsächlich gibt die neue Regelung darauf keine abschließende Antwort. Festgelegt ist, dass die zuständige Behörde die Prüfungskommission bestellt. Als Termine können die regulären staatlichen Prüfungen an den Fakultäten genutzt werden – sie müssen es aber nicht. Aus Sicht des Medizinischen Fakultätentags (MFT) ist es zunächst einmal wichtig, dass an den Prüfungen Hochschullehrer beteiligt sind. Die Prüfungen an den Terminen der Staatsexamina abzuhalten, sei in großen Bundesländern mit mehreren Fakultäten praktikabel, in kleineren eher nicht. „Selbstverständlich ist für eine adäquate Finanzierung dieser zusätzlichen Aufgaben zu sorgen“, fordert Dr. Volker Hildebrandt, MFT-Generalsekretär. Dass die ausländischen Ärzte gemeinsam mit den Medizinstudierenden geprüft würden, sei nicht möglich. Inhalt und Dauer der Prüfung seien unterschiedlich.
